Most of Texas participates in a deregulated electricity market thanks to Senate Bill 7, passed in 1999. This legislation gave Texans in eligible areas the power to choose their electricity provider and shop for their own electricity plans.

However, some areas—such as those served by municipal utilities or electric cooperatives (co-ops)—chose to opt out of competition. These providers are locally owned and governed. As a result, while the majority of Texans can compare plans and switch providers, a few regions remain in a non-competitive electricity market by choice or necessity because of lacking infrastructure.

Providers disclose only the energy and delivery charges, as well as all associated fees of the plan, in their Electricity Facts Label (EFL), which can be more complicated than the advertised rate. As the market has become more competitive, rate programs have grown very complicated and highly structured. This complexity makes the Power to Choose website extremely confusing for most people.

What a customer believes he or she is getting could be drastically different from reality. Energy Ogre’s systems interpret the rate offer in its entirety, taking into account every fee, delivery charge, and tax for any amount of consumption (so there are no surprises).
